Title Insurance Underwriting

Title insurance underwriters are employed by an insurance company to work on the process of validating property ownership and liens in a real estate transaction. Title insurance underwriting is a specialized type of insurance that protects the policyholder against loss from something that has already happened, such as a forged deed somewhere in the ownership history. These companies thoroughly examine the chain of owners and lien holders to prove that the title is insurable. The determining factor which allows a property to be insured is the lack of noticeable defects in the records which would cause a future claim.

By insuring a policy, the underwriters are agreeing to defend the policyholders title in court should any lawsuits arise with adverse claims. These agencies create lists of specific policy exclusions that are not covered by the this protection. The exclusions include such things as: the rights of parties in possession, unrecorded easements, encroachments, zoning laws, and other governmental restrictions. The remaining attributes that are insured by a title insurance underwriting company are known collectively as a "marketable title". To underwriters this "marketable" property ownership means one that is not necessarily perfect, but has more insurable traits than exclusions.

Title insurance underwriters agree that a "marketable" property is free from plausible or reasonable objections. There are two types of mortgage related policies. One type of title insurance underwriters policy protects the owner against loss, the other policy protects the lender against loss. States differ on determining who pays for each type of policy. A common procedure is for the owner selling the property to pay for reasons that the owner is confident in delivering a clear ownership contract. In some parts of the country, it is the buyers' responsibility to purchase the protection of a title insurance underwriting company policies protection. Frequently, the lender's policy is mandatory and purchased by the buyer and paid for at the closing of the home.

Some Christians are hesitant to purchase underwriters policies. They feel that the purchase of insurance in general shows a lack of faith in God and His ability to protect and provide for them. The Bible does not address the issue of purchasing a title insurance underwriting company policy, but it does address the issue of planning ahead for future emergency. "And let them gather all the food of those good years that come, and lay up corn under the hand of Pharaoh, and let them keep food in the cities. And that food shall be for store to the land against the seven years of famine, which shall be in the land of Egypt; that the land perish not through the famine." (Genesis 41:35-36)
